Dear Students 5th July 2006
Welcome to another edition of my newsletters and thank you to all those new subscribers to this free service. This information will be placed on our web site but it may take a few days for this to happen.
Over the last month I had dozens of students coming to see me saying that they heard there were going to be many changes to the law from the 1st of July. As usual these rumours have proven to be false as there have been only a few changes. None of these changes were really unexpected.
1st of July 2006 Changes
The main changes are;
The old 882 visa (Skilled Designated Area-Sponsored Overseas Student) and the 139 visa (Skilled-Designated Area-Sponsored) have been replaced with a new two part system. The new arrangements will be a temporary three year visa first and then after living in the designated area for two years and having worked for 12 months, you can apply for PR. All those applications lodged before the 1st of July are not affected by these new changes. In the future I will write about these new visa’s.
TRA has abolished its old $500 express service fee. Now everyone just pays the $300 fee and the service provided by TRA has dramatically improved so there is no need for an express application. MODL Trade applications are assessed in about 2-3 weeks and the non MODL assessments, a little longer. Congratulations to TRA for this is an amazing improvement of services and it should be the benchmark all government services should aspire to.
TRA has taken over from VETASSESS in assessing Child Care Co-ordinator (ASCO- 1295-11). This will eliminate the old loophole where anyone with a Bachelor Degree could gain this assessment. It will not surprise me to see this occupation now added to the MODL as it was once before.
Business 457 visa holders and new applicants will be able to sponsor their same sex partners. Previously same sex couple were only able to be sponsored for permanent residency via the Interdependency visas (814 &110). We are not sure in the future if Onshore Overseas students who apply for PR will be able to include their same sex partners or not. I'll let you know later if this happens.
CRICOS registration is compulsory for courses studied in Australia where students are relying on this course for their TRA skill assessment result. DIMIA has back dated this rule to cover those applications where the decision is still outstanding. Currently there are hundreds of applications that have been on hold by DIMIA at the ASPC (for over 12 months now) and it seems they have been waiting for this new law change so they can now reject these applicants. It is one way of achieving their desired outcome but it can hardly be considered as fair play. This way DIMIA can just freeze applications if they are not happy about something, change the law, and then say sorry to applicants, the law has changed. Is this really customer service orientated? We think not. Decisions like this by DIMIA will only act to generate instability in the migration program amongst international students.
DIMIA fees have gone up! It is now $1990 for the onshore PR applications and $185 for the 497 visa. You can check DIMIA’s web site for the full list.
Point System Changes (Future)
I have discussed the future changes to the points system (as covered in my last newsletter) with senior management at the ASPC and have been assured that no students who finish this year will be affected. However there is no definite implementation date for the changes but my estimate will be by April or July 2007. This does not mean it won't be sooner but I feel it unlikely.
Permission to Work after lodging PR
For a while now there has been an issue about students being able to work full time after they have lodged their Onshore PR GSM applications (880, 881, 882 etc) even though their student visa’s have continued on for a few months more.
DIMIA has now revised its acknowledgement letters (though I notice the e-mail acknowledgement letter is yet to be revised) to state that students can work full time after they have finished their courses. An extract from this new letter from DIMIA is provided below;
“Students who have permission to work and who have completed their study are permitted to work unrestricted hours as their course is no longer in session”.
I have been assured by the senior management at the ASPC that students who have completed their course and applied for PR (onshore GSM applications) will not be pursued by the Student Compliance Centre to have their old student visa’s cancelled. There an informal agreement with the ASPC and the Student Compliance Centres around Australia. If a Compliance Centre receive notification from an education provider that a student has ceased study before the end of their enrolled course (eg: finish Graduate Diploma but still enrolled in a Masters program) the first thing they will check is to see if the student has applied for one of the onshore GSM classes.
When DIMIA officers find that the student has applied for PR they are meant to keep note of the file and check it again a few months later to see the result of application. Once you gain your permanent residency then of course the compliance officers don't need to worry about you. If your PR application fails, then they will take steps to cancel your student visa if it is still valid. If it has already expired then of course an expired visa cannot be cancelled.
Dear Students
Following on my newsletter released yesterday regarding the new 1st of July changes appears I need to make a correction
The Skilled Designated Area-Sponsored visa (882) is not affected by the new 2 stage visa. It does however change the Skilled Designated Area-Sponsored 139 visa.
The 139 visa can no longer be applied for after the 1st of July 2006.
The two new visa’s to replace the 139 visa are:
• Skilled - Designated Area-sponsored (Provisional) subclass 496 and
• Skilled - Designated Area-sponsored (Residence) subclass 883
Students can still apply for this new 496 temporary visa though it is primarily designed for offshore applicants. If you are prohibited for applying for the 882 visa (eg: not held the right student visa) then you can still apply for the 496 visa after completing your 2 year study here.
To apply for the new 883 visa you must have held the 496 visa and meet some basic conditions;
1. Hold a 496 visa for 2 years
2. Lived in a designated area for 2 year (short trips out our allowed) before applying.
3. Worked full-time for at least 12 months during this 2 year period, and
New Condition 8549 applies to this 496 visa;
“While the holder is in Australia, the holder must live, study and work only in a designated area in the State or Territory in which the holder’s sponsor lived when the holder was first granted a Skilled — Designated Area-sponsored (Provisional) (Class UZ) visa.”
The 882 requirements for overseas students requirements remain the same and they do not need to use the 496 visa. I am sorry to those students who may have been concerned by this mistake.

Если и будут изменения, то не раньше 1 июля 2007. А тех кто подался раньше этой даты - изменения не коснуться.

Сообщение от fuzcenДа... видимо каждый пишет о своих источниках , я лично сегодня на "коммерческом сайте" читал предположение, что изменениям все-таки быть в ноябре этого года, деньги в бюджете заложены... , а значит изменения всупят в силу, и наврядли в конце финансового года!

2. Все мало-мальски серьезные изменения вступали в силу как раз летом (например, введение SIR программы). Зимой нововведений не происходит по статистике. Возможно зимой (когда у них лето и само жарко) - активность всего понижается...
3. Чтобы провести серьезные изменения процесса - нужны серьезные изменения дейсвующего аппарата (системы). А это дело не одного месяца. Как минимум полгода. Так что если сейчас заговорили, то к реальным делам перейдут как раз к 1 июля 2007.
4. На "коммерческом" сайте - лишь какие-то туманные слова, которые были услышаны в беседе с каким-то челом... (без хоть какого-либо документального подтверждения). Не воспринимается всё это... Мало ли что они там болать могут...
5. Ну и наконец, на самом продвинутом сайте по австралийской иммиграции (immi.gov.au) тоже ни о чём реальном не упоминается... Вот как появиться на главной страничке текст "с такого-то будут введены изменения" - вот тогда можно начинать волноваться. А пока не следует...
